Lagdera MP lodges an appeal following nullification of his election victory 

Lagdera Member of Parliament Abdikadir Hussein Mohamed has appealed a high court decision that nullified his election.

He was accompanied by his lawyer Senior Counsel and Kisumu Senator Prof Tom Ojienda, and vowed to challenge the high court decision of nullifying his election.

The MP and his lawyer spoke to the media at the Supreme Court building, moments after filling their appeal and exuded confidence that the court of appeal will quash the high court decisions and uphold his victory.

Abdiqani Zeitun, a UDA candidate, filed a lawsuit alleging significant irregularities. 

The recount was conducted at the Independent Electoral and Boundaries Commission (IEBC) Warehouse in Nairobi’s Industrial District, where discrepancies were discovered. 

Abdikadir, the first MP to lose his seat, has already been granted a stay of proceedings pending an appeal. 

The MP proceeded to his Facebook page to pick holes into the judgement which he termed as ‘not Solomonic’. 

“I will fight back and become a true victor once again,” he said. 

“I ask the people of Lagdera constituency to remain calm as we reclaim back our victory.”

He won the seat on an ODM ticket.

The petition was filed by his rival Abdiqani Zeitun of the United Democratic Alliance party.

In a ruling issued on 3rd March, the court declared that the election was marred by irregularities, thus invalidating his poll win with 5,939 votes.

Zeitun had 4,863 votes while incumbent Mohamed Hire of Kanu came third with 3,277 votes.

The court ordered that a re-election be held on a date to be decided by the Independent Electoral and Boundaries Commission (IEBC).

Mr Abdikadir had been given 14 days to appeal the ruling.
